USER AGREEMENT

The privacy policy of personal data (hereinafter - the Privacy Policy) applies to all information that the LIBERT company, located on the domain name LIBERT.ua, can obtain about the User during the use of the LIBERT website, programs and products of the LIBERT company. Rolling.

1.⁣ Definition of terms

1.1 The following terms are used in this Privacy Policy:

1.1.1. «Administration of the LIBERT company website (hereinafter referred to as the site administration)» - employees authorized to manage the site, acting on behalf of the LIBERT company, which organizes and (or) carries out the processing of personal data, as well as determines the purposes of personal data processing, composition personal data to be processed, actions (operations) performed with personal data.

1.1.2. «Personal data» – any information relating directly or indirectly to a specific or identifiable natural person (subject of personal data).

1.1.3. «Processing of personal data» – any action (operation) or set of actions (operations) carried out with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use , transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.,

1.1.4. «Confidentiality of personal data» – it is mandatory for the Operator or another person who has access to personal data to comply with the requirements to prevent their distribution without the consent of the subject of personal data or the presence of another legal basis.,

1.1.5. «User of the LIBERT website (hereinafter User)» – a person who has access to the Site via the Internet and uses the Site of the LIBERT company.,

1.1.6. «Cookies» – a small piece of data sent by a web server and stored on the user's computer, which a web client or web browser sends to the web server in an HTTP request every time it tries to open a page on the corresponding site.,

1.1.7. «IP address» – unique network address of a node in a computer network built on the IP protocol.,

2.⁣ Terms,

2.1. The User's use of the LIBERT website means agreement with this Privacy Policy and the terms of processing the User's personal data.,

2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the LIBERT website.,

2.3. The actual Privacy Policy applies only to the website of the LIBERT company LIBERT.com. The LIBERT company does not control and is not responsible for third-party websites to which the User can go via the link available on the LIBERT website.,

2.4. The website administration does not verify the authenticity of personal data provided by the User of the LIBERT website.,

3.⁣ The subject of the privacy policy,

3.1. The actual Privacy Policy establishes the obligations of the LIBERT website administration regarding non-disclosure and ensuring the privacy protection regime of personal data, which the User must provide to the site administration upon request when registering on the LIBERT website or when making a reservation.

3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out the registration form on the LIBERT website LIBERT.com and includes the following information:

3.2.1. last name, first name of the User;

3.2.2. the User's contact phone number;

3.2.3. email address (e-mail);

3.2.4. site user registration address (registration);

3.2.5. place of residence of the Site User;

3.2.6. scan copy of passport, driver's license and identification code.

3.3.1. Disabling cookies may make it impossible to access parts of the LIBERT website that require authorization.

3.3.2. The LIBERT company collects statistics about the IP addresses of its visitors. This information is used for the purpose of identifying and solving technical problems, to control the legality of financial payments made.

3.4. Any other personal information not stipulated above (booking history, used browsers and operating systems, etc.) is subject to reliable storage and non-distribution, except for the cases provided for in paragraph 5.2. and 5.3. of this Privacy Policy.

4.⁣ The purpose of collecting the user's personal information

4.1. The administration of the LIBERT website may use the User's personal data for the following purposes:

4.1.1. Identification of the User for making a reservation and (or) concluding a remote car reservation contract with the LIBERT company.

4.1.2. Providing the User with access to the personalized resources of the LIBERT website.

4.1.3. Establishing feedback with the User, including sending messages, requests regarding the use of the LIBERT Website, providing services, processing requests and applications from the User.

4.1.4. Determining the location of the User to ensure security and prevent fraud.

4.1.5. Confirmation of authenticity and completeness of personal data provided by the User.

4.1.6. Notification of the Site User by the LIBERT company about the status of the reservation.

4.1.7. Processing and receipt of payments, confirmation of tax or tax benefits, denial of payment, determination of the right to receive a credit line by the User.

4.1.8. Providing the User with effective customer and technical support in the event of problems related to the use of the LIBERT website.

4.1.9. Provision to the User, with his consent, of product updates, special offers, price information, newsletters and other information on behalf of the LIBERT company.

4.1.10. Carrying out advertising activities with the consent of the User.

4.1.11. Providing the User with access to the sites or services of LIBERT partners for the purpose of obtaining products, updates and services.

5.⁣ Methods of collecting and processing personal information

5.1. The processing of the User's personal data is carried out without a time limit, in any legal way, including in personal data information systems with the use of automation tools or without the use of such tools.

5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, solely for the purpose of fulfilling the User's order placed on the Website of the LIBERT company "LIBERT.ua".

5.3. The User's personal data may be transferred to the authorized bodies of the state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.

5.4. In case of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.

5.5. The site administration takes the necessary organizational and technical measures to protect the User's personal information from illegal or accidental access, destruction, distortion, blocking, copying, distribution, as well as from other illegal actions of third parties.

5.6. The site administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.

6.⁣ Obligations of the parties

6.1. The user is obliged to:

6.1.1. Provide information about personal data necessary for using the LIBERT website.

6.1.2. Update and supplement the provided information about personal data in the event of a change in this information.

6.2. The site administration is obliged to:

6.2.1. Use the received information exclusively for the purposes specified in Clause 4 of this Privacy Policy.

6.2.2. To ensure that confidential information is kept confidential, not to be disclosed without the prior written consent of the User, as well as not to sell, exchange, publish, or disclose in other possible ways the transferred personal data of the User, with the exception of para. 5.2. and 5.3. of this Privacy Policy.

6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure that is usually used to protect this kind of information in the existing business turnover.

6.2.4. To block personal data related to the relevant User from the moment of application or request by the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of unreliable personal data or illegal actions.

7.⁣ Responsibilities of the parties

7.1. The administration of the site, which has not fulfilled its obligations, is responsible for the losses incurred by the User in connection with the improper use of personal data, in accordance with the legislation of Ukraine, with the exception of the cases provided for in paragraph 5.2., 5.3. and 7.2. of this Privacy Policy.

7.2. In case of loss or disclosure of Confidential Information, the Site Administration is not responsible if this confidential information:

7.2.1. Became public property until its loss or disclosure.

7.2.2. It was received from a third party before it was received by the Site Administration.

7.2.3. It was disclosed with the consent of the User.

8.⁣ Settlement of Disputes

8.1. Before filing a claim in court in disputes arising from the relationship between the User of the LIBERT website and the Site Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).

8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, inform the applicant of the claim in writing about the results of the consideration of the claim.

8.3. In case of failure to reach an agreement, the dispute will be referred to a judicial authority in accordance with the current legislation of Ukraine.

8.4. The current legislation of Ukraine applies to this Privacy Policy and the relationship between the User and the Site Administration.

9.⁣ Additional conditions

9.1. The site administration has the right to make changes to the current Privacy Policy without the User's consent.

9.2. The new Privacy Policy enters into force from the moment it is posted on the LIBERT website, unless otherwise provided by the new version of the Privacy Policy.
